By accessing or using the COURSER platform ("Service"), including our website, mobile applications, and any associated services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and COURSER Technologies Ltd. ("COURSER," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the platform at least 30 days before they take effect.

You must be at least 18 years of age and have the legal capacity to enter into binding agreements in your jurisdiction to use the Service. By creating an account, you represent and warrant that all registration information you submit is truthful, accurate, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify COURSER of any unauthorized use of your account or any other breach of security.

COURSER reserves the right to refuse registration, suspend, or terminate any account at our sole discretion, including but not limited to cases where we suspect fraudulent activity, identity misrepresentation, or violation of these Terms.

COURSER requires identity verification for all members. By submitting verification documents, you consent to our collection and processing of personal identification information, including government-issued photo ID, proof of address, and biometric data for identity confirmation.

Verification status does not constitute an endorsement, guarantee, or warranty by COURSER regarding any member's character, financial standing, or the quality, legality, or safety of any vehicle listed on the platform.

COURSER provides a platform for connecting buyers and sellers of luxury automobiles. We are not a party to any transaction between users. All transactions, including negotiation, payment, delivery, title transfer, and dispute resolution, are solely between the buyer and seller.

Sellers represent and warrant that they have full legal authority and clear title to sell any vehicle listed on the platform. Listings must accurately describe the vehicle's condition, history, specifications, and any known defects or issues. Misrepresentation of a vehicle is a serious violation of these Terms and may result in immediate account termination and legal action.

Buyers acknowledge that they are responsible for conducting their own due diligence, including independent vehicle inspections, title searches, and verification of all information provided by the seller before completing a purchase.

Access to certain features of the Service requires a paid membership subscription. Membership fees are billed in advance on a monthly or annual basis depending on your selected plan. All fees are non-refundable except as expressly stated in our refund policy or as required by applicable law.

COURSER reserves the right to change subscription fees upon 30 days' written notice. Fee changes will take effect at the start of your next billing cycle following the notice period. Your continued use of the Service after the fee change constitutes acceptance of the new fees.

We offer a 30-day money-back guarantee on all new subscriptions. If you are not satisfied within the first 30 days, contact our support team for a full refund.

You agree not to use the Service for any unlawful purpose or in violation of any applicable laws or regulations. The following activities are expressly prohibited:

• Listing stolen vehicles, vehicles with undisclosed liens, or vehicles you do not own or have authority to sell
• Providing false, misleading, or inaccurate information in listings, profiles, or communications
• Manipulating or interfering with the verification process
• Harassing, threatening, or intimidating other members
• Circumventing or attempting to circumvent platform fees or transaction processes
• Using automated systems, bots, or scrapers to access the Service without express written permission
• Attempting to gain unauthorized access to other user accounts or COURSER systems
• Infringing upon the intellectual property rights of COURSER or any third party
• Engaging in money laundering, terrorist financing, or any other financial crime

The Service, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, software, and compilation thereof), is owned by COURSER or its licensors and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

By submitting content to the Service (including vehicle listings, photos, and reviews), you grant COURSER a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, display, and distribute such content in connection with the operation of the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

We comply with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other applicable data protection laws. You have the right to access, correct, delete, and port your personal data as described in our Privacy Policy.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

COURSER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. COURSER DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE, INCLUDING VEHICLE LISTINGS, MEMBER PROFILES, OR MARKET DATA.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COURSER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL COURSER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO COURSER IN MEMBERSHIP FEES DURING THE TWELVE (12) MONTHS PRECEDING THE DATE OF THE CLAIM.

You agree to indemnify, defend, and hold harmless COURSER and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of London, England.

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute through good-faith negotiation by contacting our legal team at legal@concours.io. If the dispute cannot be resolved within 30 days, either party may pursue formal legal remedies.

You may terminate your account at any time by contacting our support team or using the account deletion feature in your settings. COURSER may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

COURSER reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
